RULES OF THE GRESFORD COLLIERY SPORTS AND SOCIAL CLUB Name 1. The name of the club is GRESFORD COLLIERY SPORTS AND SOCIAL CLUB.
Objects 2. The Club is formed for the promotion of social intercourse, mutual helpfulness, mental and moral improvement, rational recreation and for the support of the charitable activities of the Gresford and Pandy Sport and Leisure Limited, who’s registered address is at Recreational Grounds, Bluebell Lane, Pandy, Wrexham LL12 8EE (Company number 07574079) “The Charity”.
Qualification for Membership 3. Persons who are, or have or have been connected directly or indirectly with the coal mining industry or live in a past or present mining area and their relatives or dependants and those who are in general sympathy with the aims and objects of the Club are qualified for membership.
Management Board 4. The Management of the club shall be vested in the Management Board of the Gresford Colliery Sports and Social Club Limited who registered address office is at Recreational Grounds, Bluebell Lane, Pandy, Wrexham LL12 8EE (company number 7577626) “The Company”, who shall also deal with all the matters that are usually dealt with by the committee of a club. The Management Board may also be referred to as the “Committee” of the Club.
Management Board to Provide Club Premises and Pay Expenses 5. The Management Board shall provide the club with club premises in the Company’s Registered Office and everything reasonably necessary for carrying on the club in accordance with its objects and these rules and will be solely responsible for all expenses connected therewith and for the engagement and payment of servants and for catering and all other matters involving expenditure of money.
Rights and Liabilities of Members 6. Every member shall, subject to these rules and any byelaws which may be made under them be entitled to use and enjoy in common with the other members of the club the premises and furniture, fitting and other things therein provided by the company for the use of the club but shall not by reason of his/her membership be under any financial liability except for the payment of his/her annual subscription.
Membership 7. The club shall consist of ordinary members (including life members elected under Rule 8) and of honorary members elected in accordance with (Rule 9). Membership is open to all persons aged 18 and over. People under the age of 18 may use the facilities as long as they are accompanied by a club member/guest. Membership cards must be carried at all times while using the club facilities in order to receive the member’s privileges.
Life Members 8. Ordinary Members may, in special circumstances, be elected life members at any general meeting of the club and shall thereafter be entitled to all the privileges of membership without paying the yearly subscription or any special payment for such life membership. A two-thirds majority of those present and voting shall be necessary to ensure election.
Honorary Membership 9. Honorary members may be elected at any general meeting of the club over and above the compliment of ordinary members. A two-thirds majority of members present and voting shall be necessary to ensure election. Honorary members may be elected for life or such period as the general meeting may deem expedient. They shall be entitled to all privileges of membership. The election of honorary members shall be subject to the prior approval of the Management Board.
Members of the Club to be Members of the Company 10. No person shall become a member of the club unless and until he/she becomes a member of the company. A member shall cease to be a member of the club as soon as he/she ceases to be a member of the company.
Guests 11. Any person attending a pre booked function, approved by the Management Board and Club staff, is deemed as a guest. Guests can also be friends of members, or any person using the Club recreational facilities for sporting activities. The Management board or club staff shall hold a record of the person booking a private function.
Entrance Fees
12. There shall be an entrance fee payable by a member on election, which shall be a sum (if any) as the Management Board shall from time to time determine. The Management Board may demand entrance fees of varying amounts and in exceptional circumstances remit the whole or part of the entrance fee of any member or class of members.
Amount of Subscriptions 13. The annual subscription for members or class of members shall be such sum as determined by the Management Board from time to time provided that the Management Board shall not increase annual subscriptions retrospectively.
Members Abroad 14. A member absent abroad for the whole of any year shall pay such subscription as may from time to time be determined by the Management Board.
Date of Payment of Subscriptions 15. Annual subscriptions shall be due and payable on the first day of April and shall on or before that day in each year be paid to the Management Board.
Application for Membership and Proposal of Candidates 16. Every candidate for membership shall be proposed by a member, whom shall be personally acquainted with the candidate, and vouch for his/her fitness for membership. Proposals for membership must be on the forms provided by the Management Board, and must be completed with full name, contact details, postal address and shall be signed by the applicant. Completion of this form will be an undertaking to be bound by these rules and also by any byelaws, which may be made under them should membership be granted.
Election of Members 17. The election of candidates shall be by the Management Board or Club Staff and no person shall be admitted to membership until so elected. Once elected a membership card will be issued, which entitles members to all the privileges of membership and shall be deemed to have agreed to be bound by these rules and any byelaws made in accordance therewith. The Management Board reserve the right to reject an application for membership, should the applicant be known to have been banned from the Club, or other Clubs/Public Houses within the area.
Subscription in Arrears 18.Subscriptions may become in arrears during annual yearly renewal period. (Rule 15). During renewal period, notices will be displayed within the Clubhouse indicating annual subscription fees. If renewal has not occurred by 14th April of each year, that member shall forfeit all rights of membership, the Management Board shall remove his/her name from the register of members and he/she thereupon cease to be a member and forfeit all rights of membership PROVIDED that the Management Board may at any time in their discretion restore him/her to membership upon payment of all arrears of subscription then due.
Resignation of a Member 19. A member may resign his/her membership at any time by letter addressed to the Management Board at the club premises but shall be liable for his subscription for the year during which he/she resigns.
Misconduct 20.The Management Board shall have power to deal with any member whose conduct is such, in their opinion, be injurious to the character of the club or the interests of members and guests or who is suspected of such conduct.
21.In dealing with any member whose conduct was in their opinion injurious to the character of the club or to the interest of members, the Management Board may by letter invite him/her to resign his/her membership within a time specified in such a letter, and in default of such resignation to submit the question of his/her expulsion or suspension from membership for a fixed or undefined period in writing within the time specified. On receipt of reply from the member, the Management Board shall consider all known facts, and determine an outcome. The Management Boards decision will be sent in letter to the member concerned to the address given at annual membership renewal by the member. If the member fails to respond within the given timescale within the letter, membership will automatically be terminated. Any decision made by the Management Board to expel or suspend a member under this Article shall be final and conclusive. It shall be within the power of the Management Board to exclude such member from the premises used by the club, while communications take place between the Management Board and Member concerned. It shall also be in the power of the Management Board to give a member a reprimand or warning when dealing with matters, without asking that member to resign as provided in this article. When the Management Board have justified grounds for suspecting a member of such conduct as mentioned in Rule 20 they shall investigate the matter and may also suspend that member from membership pending the outcome of such investigation.
22. If a member of the Management Board is suspended under rules 20 and 21, he or she shall vacate their seat on the Management Board during the period of his or her suspension. If Membership of a member of the Management Board shall be terminated in accordance with these rules, he or she shall also cease to be a member of the Management Board.
23.Acceptance of Rules 20 to 23 shall be implicit in membership of the club. Adherence to any local Byelaws as displayed within the Club House must also be followed.
General Meetings of the Club 24. A General Meeting (AGM) of the club will ideally be held once in every year, but must be within fifteen calendar months from the end of the accounting period of the company and/or the previous AGM. The Management Board must display notice within the Clubhouse at least 21 days prior to the AGM indicating date/time and venue of meeting.Special General Meetings may be called at any time by the Management Board or by any 20 member by giving 14 days’ notice to the membership. No business other than that specified in the notice shall be transacted at a special general meeting.
Voting at General Meetings
25. At all general meetings of the club every member of the club shall be entitled to be present (unless under investigation/suspension for breach of rules 20-23) to have one vote and no more upon every question PROVIDED that in the case of equality of votes the chairman of the meeting shall have a second or casting vote.
Officers 26. The club may from time to time in accordance with these rules or any other bylaws made under them elect a secretary or treasurer or other officers. The secretary of the company may also act as treasurer of the club.
Secretary of the Club 27. The Secretary shall keep copies of all letters and other correspondence in a manner approved by the Management Board, which shall be deemed to be the rightful owner of such records. The Secretary shall also keep a record of a list of members, to include full name and address of each member and a record of their most recent payment of their subscriptions.
Secretary of the Company 28. The secretary of the company, if he/she is a member of the club, may be elected secretary of the club, and if he/she is not so elected shall (if required by the company) act as assistant secretary of the club without payment.
Supply or Sale of Alcohol and Tobacco 29. The supply to the club of intoxicating liquors and tobacco shall be under the sole control of the Management Board. The supply of Alcohol to members and the sale of alcohol to guests shall always be in accordance with the licensing laws as they apply at the relevant time. No intoxicating liquor shall be supplied to any person who is below the age of 18.
No Tobacco confectionary shall be supplied to any person who is below the age of 16.
Intoxicating Liquor may only be supplied or sold as appropriate to the following persons or classes of persons for consumption on the premises:-
A member;
A guest;
Players and officials of any recognised team providing they are visiting the charity or the club to participate in an official pre-arranged match or fixture against an opposing team and also guests of such persons, but these provisions shall only apply on the day of such official pre-arranged match or fixture;
Persons attending a function which has been organised with the club Steward (and/or bar staff) provided that the organiser of the event, are present throughout the function;
On a justified complaint from an officer or member the person or persons designated to supervise the club shall have the power to expel immediately any person from the club premises whose conduct in in their opinion such as to disturb the quiet and peaceful enjoyment of the members. The expelled member shall not enter the club premises until the Management Board have dealt with the case under Rules (21 – 24).
A member may also be denied entry to the club premises if he/she is subject to a ban or any other measures taken against him or her under a Pub Watch Scheme to which the company or the club is a part PROVIDED that such a ban or other measures shall always be exercised strictly in accordance with the written procedures in the said Pub Watch Scheme and not otherwise.
Intoxicating Liquor shall not be supplied for consumption off the premises to any person who is not a member or a bona fide guest of a member or of the Management Board.
Members and Clubhouse visitors are not permitted to bring their own Alcohol or any other product sold in the clubhouse, within the Club Grounds or the Clubhouse without prior consent from the Club Steward, Assistant Steward or bar staff.
Smoking is not permitted in any area within the Club House. Smoking is permitted outside the building.
Permitted Hours for the Supply or sale of Alcohol 30. The permitted days and hours for the supply of intoxicating liquor shall be as per our Local Licensing Byelaws. A copy of which, along with opening times shall be displayed within the Clubhouse.
Use of Gaming Machines / Snooker and Pool Table 31. Only Members and Guests aged 18 and over are permitted to use the Gaming Machines. Members and Guests aged 16 and over may purchase tickets from the Club Lottery Machine. No person under the age of 14 is permitted to use the snooker table. Persons aged between 14 and 18 may use the Snooker table when accompanied by an appropriate member or guest. Children may use the Pool table when accompanied with an appropriate member or guest. Food must not be consumed above the pool or snooker table.
Private Benefit not to Accrue on Purchase etc. of Liquor 32. No person shall at any time be entitled to receive at the expense of the club or any member thereof any commission, percentage or similar payment on or with reference to purchases of intoxicating liquor by the club; nor shall any person directly or indirectly derive any pecuniary benefit from the supply of intoxicating liquor by or on behalf of the club to members or guests apart from any benefit which a person derives indirectly by reason of the supply giving rise to or contributing to a general gain from the carrying on of the club.
Premises Licence 33. With the prior written consent of the Trustees of the Gresford and Pandy Sport and Leisure Limited the Management Board may apply for a premises licence under the Licensing Act 2003 in respect of the club premises PROVIDED that the areas reserved for club members only shall be adequately indicated by signage. A Copy of this Licence “where applicable” shall be displayed within the Clubhouse.
Byelaws 34. The Management Board may from time to time make, vary or revoke byelaws not inconsistent with these rules for the regulation of the club and the conduct of their members. All byelaws shall, until revoked by the Management Board, be binding on members.
Club Notices 35. All notices required by these rules or any byelaws made under them will be displayed within the Clubhouse.
Settlement of Disputes 36. Any dispute or difference which may arise as to the meaning or interpretation of these rules or any byelaws made under them shall be determined by the Management Board, whose decision shall be final and binding upon all members. The Management Board shall not be required to give reasons for their decisions.
Amendment of Rules 37. These rules and any of them may from time to time be revoked, altered or added to by the Management Board. Notices of any changes will be communicated within the Clubhouse, or depending on the nature may be introduced as a Byelaw (Rule 34).
Interpretation 38. In the interpretation of these Rules “the company” means Gresford Colliery Sports and Social Club Limited, “the club” means Gresford Colliery Sports and Social Club, and “member” and “secretary” means respectively member of the club and secretary to the club.
Bye-Laws 1. All Members shall pay the full cost of repairing or replacing any article or property of the Club that has been damaged, destroyed or lost by them or their guests. 2. No Member shall on any pretense take away, injure or destroy any articles that are the property of the Club. 3.All complaints or suggestions shall be made using the club suggestion box, and must be signed in full by the Member(s) making them. Current membership number must also be quoted. 4.Every Member shall complete a new membership form should any personal details change. No fee applies for this. 5.If a Membership card is lost, the member must complete a new membership form – A new membership number and card will be issued. A fee will apply for this. 6.Members need to ensure the relevant facilities required by the clubs sports sections are available for any planned matches/events. (Pool, Snooker, Dominoes, Darts, Bowling Green and Football pitch). 7.Dogs are welcome within the Clubhouse, but must be with a Club Member at all times. Dogs are not permitted on the club furniture. Dogs (Except Guide Dogs) are not permitted within the bowling green area or on the football pitch. 8. The use of illegal drugs within the Clubhouse, or on club grounds will not be tolerated, and any member caught, will be dealt with by the management board under club Rules 20 – 23. 9.Offensive and Foul Language Must not be used – please respect other club Members and Guests. 10. Food, or any other product not purchased from within the Clubhouse should be consumed, without prior consent from the Club Steward, Assistant Steward or Bar Staff. 11. Should any member wish to communicate with the Management Board, other than via the Suggestion/Comments box within the Clubhouse, they can also do so in writing, to the Club Secretary at the Clubs registered address of: Gresford Colliery Sports and Social Club, Recreational Grounds, Bluebell Lane, Pandy, Wrexham, LL12 8EE.
